In some areas of the state, the supply of groundwater is
restricted by an underground water district or authority. Often
these measures may impact utility revenues from the sale of water.
Recognizing this impact, in an effort to assist the privately owned
utility, the TCEQ rules allow for the recovery of the revenues lost
due to water restriction.
A utility's tariff may include a temporary water rate provision
which will allow the utility to increase its retail customer rates
during periods when a court, government agency, or other authority
orders mandatory water use reduction measures which affect the
utility customers' use of water service and the utility's water
revenues. [See 30 TAC 291.21(l)]
Use of the temporary water rate provision after approval by the
Texas Comission on Environmental Quality (TCEQ) will allow the
utility to recover from customers revenues the utility would
otherwise have lost due to mandatory water use reductions.
