§Non-acute Public Notification Requirements of 30 TAC
290.122 (b) MCL, MRDL, or Treatment Technique Violations
Violation Report Form
1. Notify TCEQ by the end of the next business day
2. Submit to TCEQ copies of all notifications within ten days of
distribution
3. Initial public notice:
- Within 30 days; and Include mandatory health effects
language.
- Community systems:
- Notify customers by by mail or other
direct delivery to each customer and all other persons served by
the system; and Any other method reasonably calculated to reach
other persons regularly served by the system.
- Noncommunity systems:
- Notify by direct delivery; or
Continuously post the notice in conspicuous places for as long as
the violation exists or at least 7 days.
4. Additional notice:
- Include mandatory health effects language.
- Community systems:
- Issue a notice at least every three
months by mail or by direct delivery, for as long as the violation
exists.
- Noncommunity systems:
- If the initial notice was by
continuously posting, it must be posted for as long as the
violation exists or at least 7 days; If the initial notice was by
direct delivery, notice by direct delivery must be repeated at
least every three months for as long as the violation exists.
5. When the violation is corrected, notification must be issued
in the same manner as the original notice was issued.
