New Pretreatment Program Development

The TPDES permit for a publicly-owned treatment works (POTW) that is required to develop a pretreatment program will include a schedule of activities (compliance schedule). The activities will be required to be submitted to the Texas Commission on Environmental Quality (TCEQ) Pretreatment Program according to the specified dates. The first activity will be to conduct an industrial user survey to determine if there are significant industrial users and/or categorical industrial users discharging to your sewer system. Based on the survey results the TCEQ may terminate the requirement to develop a pretreatment program or may require continuation of the schedule of activities according to 40 CFR §403.8(a)-(c)Exit TCEQ.

If a POTW is required to develop an approved pretreatment program, the final technically complete package is due 12 months after the effective date of the TPDES permit.

To develop a new pretreatment program you will need to complete and submit the applicable checklists: legal authority (TCEQ-20224), enforcement response plan (TCEQ-20225), resources (TCEQ-20226), program implementation procedures (TCEQ-20222), inspection report (TCEQ-20223).
