Activities with Hazardous Waste That Require Notification of the TCEQ

This list of activities summarizes those in Title 30 Texas Administrative Code Section 335.6. See the rule itself for specific notification requirements.

Activities That Require Notifying the TCEQ

Facilities that are exempt from permitting requirements but still need to notify the TCEQ at least 90 days before beginning an activity fall into 6 general groups:

• Conditionally exempt small quantity generators;
• Farmers disposing of pesticides
• On-site Processes
  • Less than 90-day accumulation or processing in tanks, containers, containment buildings and drip pads
  • Addition of absorbent material in a container
  • On-site disposal of non-hazardous industrial solid waste
  • Certain recycling operations
• Types of Treatment Units:
  • Elementary neutralization units
  • Wastewater treatment units
  • Please note that, in accordance with Senate Bill 1281 passed during the 79^th Legislative Session, a commercial industrial solid waste facility discharging into a Publicly Owned Treatment Works will be required to obtain a permit by June 1, 2006.
• Certain Waste Management Activities:
  • Emergency response cleanup
  • Treatability studies
• Specific Types of Facilities:
  • Publicly owned treatment works (POTW)
  • Municipal and solid waste management facilities who also manage hazardous waste from a conditionally exempt small quantity generator
  • Totally enclosed treatment facilities;
  • Transfer facilities
  • Certain solid waste disposal facilities

• Name of facility where the unit will be located
• Facility location
• TCEQ industrial solid waste registration number
• Contact person name, address, and phone number
• Type of unit
• Location of unit at the facility
• Unit design information
• Description of type and amount of waste to be managed in the unit
• Description of daily operations of unit
• Inspections of unit (frequency and items to be inspected)
• Description of how unit will be closed
