Municipal Solid Waste Landfill (MSWLF) sites subject to Title 40
Code of Federal Regulations (40 CFR) Part 60, Subpart WWW
(Standards of Performance for Municipal Solid Waste Landfills),
or 40 CFR Part 63, Subpart
AAAA (National Emission Standards for Hazardous Air Pollutants:
Municipal Solid Waste Landfills) are required to be permitted
under a Title V permit and may apply to operate under the MSWL GOP
Permit Number 517.
Streamlined Processing
The TCEQ has amended and is adopting a new streamlined approach
to MSWLF preconstruction and federal operating permit requirements.
As a part of this process, and to meet federal requirements, the
only sites able to use the MSWLF GOP No. 517 in the future will be
those who can meet 30 Texas Administrative Code (30 TAC) Chapter
106
Permits by Rule under Section 106.534, 
or the
Standard Permit under Section 330.981, See the
Guidance for additional information on the various air
authorizations and requirements.
To further assist MSWFL operators in determining whether their
site needs a GOP, the TCEQ has developed a GOP Checklist (available
in PDF
or DOC)
and a NSPS WWW GOP Applicability checklist (available in PDF
or DOC)
which may show the need for a GOP. Once it is determined that a GOP
is needed, an application needs to be submitted (or updated if
previously submitted). The GOP Application Form is combined with
the Standard Permit Certification (available in PDF
or DOC)
and must be submitted by the landfill’s Responsible Official
(RO) or Duly Authorized Representative (DAR). No fee is required
with a GOP application. When you apply or update information for a
GOP, the submittal must demonstrate how and why you are subject to
meet various state and federal requirements of the GOP. To make
