Publishing Air Notices in Alternative Languages

This Web page discusses publishing air notices in alternative languages. It describes how to determine if an air notice must be published in an alternative language, how to translate the notice, as well other helpful information for publishing these notices.

When Is an Alternative Language Required?

As part of the process of obtaining an air permit, the applicant must complete our alternative language checklist available in PDF (Help with PDF) or DOC. This checklist helps to determine whether you must publish public notices in languages other than English. If alternative language is required, both the Notice of Receipt and Intent to Obtain a Permit (NSR First Notice) and the Notice of Preliminary Decision and Draft Permit (NSR Second Notice and Title V Notice) must be translated.

Does This Apply to Small Businesses?

Yes. However, applicants who meet the Texas Commission on Environmental Quality criteria for a small business stationary source and whose emissions will not have a significant impact on air quality are not required to publish the prominent newspaper notice in any language, but you must still publish a notice in the "public notice" section in all required languages.

Who Must Get the Notice Translated?

The applicant is responsible for getting notices translated. However, because Spanish is the most common alternative language, we have provided some commonly needed translated templates and a Spanish-language glossary in PDF or DOC of air contaminants. By replacing only the italicized sections of the corresponding template with the correctly translated information, applicants can easily obtain a Spanish notice for their situation.

Public Notice Verification and Affidavit Forms

The following forms must be submitted for verification of the publication of both the English and alternative language notices. These forms are also included in the public notice instructions that were sent by the Air Permits Division.
