Open-Participation Advisory Group on Rulemaking for the Outdoor
Burning Rules (Chapter 111, Subchapter B)
The purpose of this rulemaking is to implement Senate Bill 1710
and House Bill 39 which amends Section 382.018 of the Health and
Safety Code. These two statutes require
revisions to the Commissions's rules regulating outdoor burning of
trees, brush, grass, leaves, branch trimmings, and other plant
growth from certain properties. The Open-Participation
Stakeholder's Group on Rulemaking for the Outdoor Burning Rules was
formed to solicit comments from anyone interested in these rule
revisions regarding outdoor burning in Texas.

Stakeholder Meeting Information
The Texas Commission on Environmental Quality (TCEQ) held a
public meeting in Austin, Texas, on Thursday, September 22, 2005,
from 1:30 p.m. to 4:00 p.m. at the TCEQ Main Campus, 12100 Park 35
Circle, Bldg E, Room 201S, Austin, Texas. This public meeting
provided an opportunity for interested parties to give their
comments to TCEQ staff regarding the revision to the outdoor
burning rule.
Agenda for Proposal
The Outdoor Burning rule was approved for proposal at the
January 25, 2006, agenda.
Texas Register Publication
The proposed rule was published in the Texas Register on
February 10, 2006.
Submittal of Comments
The public comment period is from February 13, 2006 through
March 13, 2006.
Comments may be submitted to Joyce Spencer, MC 205, Texas
Register Team, Office of Legal Services, P.O. Box 13087, Austin,
Texas 78711-3087 or faxed to 512/239-4808. All comments should
reference Rule Project Number 2005-041-111-CE. Comments must be
received by 5:00 p.m., Monday, March 13, 2006. Copies of the
proposed rules can be obtained from the commission's Web site

Announcement of Hearing
A public hearing on this proposal will be held in Austin on
Tuesday, March 7, 2006, at 10:00 a.m., at the Texas Commission on
Environmental Quality complex located at 12100 Park 35 Circle,
Building B, Room 201A. The hearing will be structured for the
receipt of oral or written comments by interested persons.
Individuals may present oral statements when called upon in order
of registration. There will be no open discussion during the
hearing; however, an agency staff member will be available to
discuss the proposal 30 minutes prior to the hearing and will
answer questions before and after the hearing.
Persons with disabilities who have special communication or
other accommodation needs who are planning to attend the hearing
should contact Joyce Spencer, Office of Legal Services, at
512/239-5017. Requests should be made as far in advance as
possible.
