New Business

  1. Consideration of the Commissioners' priorities on rule and policy development. The Commissioners discussed this item in conjunction with new business item #8.

  2. Consideration of the Commission's response to an interim implementation policy on new or revised ozone and particulate matter national ambient air quality standards. Herb Williams (Air Policy and Regulations) presented this item. The Commissioners directed staff to proceed with submitting the revised comments to EPA as recommended but reserved the right to make non-substantive editorial changes coordinated by the General Counsel. The letter will be signed by all Commissioners and copies sent to applicable Texas Legislative Committee Chairs, Legislators who have been contacted by EPA, and the Texas Congressional Delegation.

  3. Consideration of the Commission's response to proposed national ambient air quality standards for ozone. Herb Williams (Air Policy and Regulations) presented this item. The Commissioners directed staff to proceed with submitting the revised comments to EPA as recommended but reserved the right to make non-substantive editorial changes coordinated by the General Counsel. The letter will be signed by all Commissioners and copies sent to applicable Texas Legislative Committee Chairs, Legislators who have been contacted by EPA, and the Texas Congressional Delegation.

  4. Consideration of the Commission's response to proposed federal requirements for designation of reference and equivalent methods for PM2.5 and ambient air quality surveillance for particulate matter. Herb Williams (Air Policy and Regulations) presented this item. The Commissioners directed staff to proceed with submitting the revised comments to EPA as recommended but reserved the right to make non-substantive editorial changes coordinated by the General Counsel. The letter will be signed by all Commissioners and copies sent to applicable Texas Legislative Committee Chairs, Legislators who have been contacted by EPA, and the Texas Congressional Delegation.

  5. Consideration of the Commission's response to proposed national ambient air quality standards for particulate matter. Herb Williams (Air Policy and Regulations) presented this item. The Commissioners directed staff to submit comments to EPA which included only the primary recommendation. The secondary recommendations should be removed. The Commissioners reserved the right to make non-substantive editorial changes coordinated by the General Counsel. The letter will be signed by all Commissioners and copies sent to applicable Texas Legislative Committee Chairs, Legislators who have been contacted by EPA, and the Texas Congressional Delegation.

  6. Consideration of issues related to the Clean Industries Plus Program. Andrew Neblett (Pollution Prevention and Recycling), Kathey Ferland (Pollution Prevention and Conservation), and Rob Borowski (Clean Industries) presented this item. The Commissioners directed staff to proceed with implementation of the program as proposed, including the development of criteria for the discipline and readmission of companies not in compliance with environmental law and agency rules.

  7. The Commission will consider in open meeting legislative matters related to its jurisdiction, including proposed legislation and related position papers, briefing materials, and status reports. The Commission may also meet in closed meeting to receive legal advice regarding these matters as authorized by Section 551.071 of the Open Meetings Act, Chapter 551 of the Government Code. Any Commission action, decision, or vote on these matters will be made in open meeting in accordance with Section 551.102 of the Open Meetings Act, Chapter 551 of the Government Code. The Commissioners chose not to discuss this item at this time.

  8. Planning for the next Commissioners' Work Session. The next Commissioners' Work Session is scheduled to be held on Thursday, April 3rd, at 1:30 p.m. in E-201S. The Commissioners are tentatively scheduled to discuss Chapter 317 (Designs and Specs)/Chapter 309 (Effluent Limitations) and legislative issues.
