with Texas Government Code, Section 2001.039, which provides for quadrennial
review of agency rules. That review indicates in accordance with a decision of the
Texas Supreme Court and a subsequent opinion of the Texas Attorney General that
the statute on which Subchapter A is based, Tex. Water Code, Section 26.179, is
invalid. Therefore, the repeal of Chapter 216, Subchapter A is appropriate. In
addition, the rulemaking initiated in response to the Petitions for Rulemaking
submitted by the City of Austin relating to Chapter 216, Subchapter A, will be
