The amendments to Chapter 114 are one element of the control strategy in the Texas SIP in order to control ground-level ozone. The rules implement the California Low Emission Vehicle program in the State of Texas to reduce emissions of oxides of nitrogen necessary to demonstrate attainment with the national ambient air quality standard for ozone. Chapter 334 has been amended to implement House Bills 2109, 2815, and 2816, 76th Legislature, 1999, and to propose changes to the rules to improve clarity, readability, and program efficiency. The new Chapter 37, Subchapter I consolidates the underground storage tanks financial assurance requirements which are proposed to be repealed from Chapter 334, Subchapter E. In addition, Chapter 37, Subchapter I proposes to incorporate federal requirements concerning financial assurance for local governments and proposes amendments consistent with the commission's regulatory reform initiative.
